Limitation of Civil Code |
|
| |
The right to require another person to do or to refrain from doing a civil act (a claim) is subject to limitation. All acts that are deemed criminal are also subject to limitation as defined in the Criminal Code. |

Claims based on a relationship governed by family law are not subject to limitation in so far as they are directed at establishing, for the future, a situation appropriate to the relationship. |

Calculation of the limited period |

All limitations of time to bring a claim are based on the date of the first alleged breach and/or event that forms the substance of the claim. The date the claim is brought is irrelevant other than it is within the limitation period for making a claim. |

| 5.3 |
10 year limitation |
|
| |
The following civil acts shall have a ten year limitation in which to bring any claim: |
|
| |
(i) All matters of non-movable property; |
|
| |
(ii) All matters relating to movable property of extreme value; |
|
| 5.4 |
5 year limitation |
|
| |
The following civil acts shall have a four year limitation in which to bring any claim: |
|
| |
(i) All matters of movable property other than property of extreme value; |
|
| |
(ii) All matters relating to obligations and contracts; |
|
| |
(iii) All matters relating to succession; |

3 year limitation |
|
| |
All claims that do not belong to any of the previous categories under 10 years or 5 year limitations shall be a maximum of 3 years by default. |
